Coin Pro is the Responsible Party for Personal Information processed under this Privacy Policy in terms of the Protection of Personal Information Act 4 of 2013 (“POPIA”).

1.5 By using the Coin Pro website or services, you acknowledge that your Personal Information may be processed as described in this Privacy Policy and in accordance with applicable law.

1.6 Coin Pro does not provide custodial wallet services and does not hold, store or control customers’ private keys.

Personal Information We Collect

2.1 We may collect identification and contact information, including your name, date of birth, nationality, identity or passport number, identity documents, residential address, proof of address and email address.

2.2 We may collect identity-verification information, including photographs, selfie images, facial images, liveness results and other information required to confirm your identity and prevent impersonation or fraud. Where biometric information is processed, it will be handled as Special Personal Information in accordance with POPIA.

2.3 We may collect financial and compliance information, including bank account details, payment information, occupation, employment information, expected transaction activity, Source of Funds, Source of Wealth, sanctions and politically exposed person screening results, adverse-media information and other information required for customer due diligence.

2.4 We may collect transaction information, including transaction amounts, dates, crypto assets, blockchain networks, exchange rates, payment references, external wallet addresses, blockchain transaction hashes, wallet-ownership information and blockchain or wallet-risk screening results.

2.5 We may also collect technical and communication information, including IP addresses, device and browser information, login and security records, website usage information, cookies, emails, support requests, complaints and other communications with Coin Pro.

How We Collect and Use Personal Information

3.1 We may collect Personal Information directly from you, automatically through our website or platform, or from third parties such as identity-verification and screening providers, banks, payment-service providers, liquidity providers, blockchain analytics providers and regulatory or law-enforcement authorities.

3.2 We use Personal Information to register and verify clients, process buy and sell orders, verify payments and external wallets, execute and settle transactions, provide customer support and administer our relationship with you.

3.3 We also process Personal Information to conduct customer due diligence, sanctions and PEP screening, transaction monitoring, blockchain screening, fraud prevention, Source of Funds and Source of Wealth reviews, record keeping and regulatory reporting.

3.4 Personal Information may additionally be used for accounting, reconciliation, audits, complaints, legal claims, platform security, service improvements and communications concerning your profile or transactions.

Legal Grounds and Required Information

4.1 By registering for Coin Pro’s services and accepting the applicable Terms and Conditions, you enter into a contractual relationship with Coin Pro. Coin Pro processes Personal Information where this is necessary to take steps requested by you before registration, verify your identity, provide services and perform its obligations under that relationship, comply with legal or regulatory obligations, protect your legitimate interests, pursue the legitimate interests of Coin Pro or a third party, or where you have provided consent.

4.2 Where processing is based on your consent, you may withdraw that consent at any time. Coin Pro may nevertheless continue to retain or process Personal Information where this is required by law or where another lawful basis applies.

4.3 Certain Personal Information is mandatory for identity verification, legal and regulatory compliance, risk assessment and transaction execution. If you do not provide the required information, or if it cannot be verified, Coin Pro may be unable to register you, process a transaction or continue the business relationship.

4.4 Coin Pro may request additional information or supporting documents where reasonably required to meet compliance, security or transaction-processing obligations.

Sharing of Personal Information

5.1 Coin Pro may share Personal Information with identity-verification and screening providers, banks, payment-service providers, transaction execution and settlement counterparties, including liquidity providers where reasonably necessary to execute or settle a transaction, blockchain analytics providers, technology and hosting providers, professional advisers, auditors and other service providers necessary to operate our business and provide our services.

5.2 We may disclose Personal Information to the Financial Sector Conduct Authority, Financial Intelligence Centre, Information Regulator, courts, law-enforcement bodies and other public authorities where required or permitted by law.

5.3 In certain circumstances, applicable law may prevent Coin Pro from informing you that information has been disclosed or that a regulatory report has been submitted.

5.4 Personal Information may also be disclosed in connection with a proposed or completed merger, acquisition, restructuring, financing or sale of all or part of Coin Pro’s business.

International Transfers

6.1 Some service providers, liquidity providers or technical systems used by Coin Pro may be located outside South Africa.

6.2 Where Personal Information is transferred outside South Africa, Coin Pro will take reasonable steps to ensure that the transfer complies with section 72 of POPIA. This may include relying on adequate data-protection laws, contractual safeguards, consent, contractual necessity or another lawful basis permitted by POPIA.

Retention of Personal Information

7.1 Coin Pro retains Personal Information only for as long as reasonably necessary to provide its services, complete and evidence transactions, meet legal and regulatory obligations, resolve complaints, investigate unlawful activity and establish, exercise or defend legal claims.

7.2 Client-identification and verification records are generally retained for at least five years after the business relationship has ended, while transaction records are generally retained for at least five years after the relevant transaction, in accordance with the Financial Intelligence Centre Act.

7.3 Information may be retained for longer where required by law, a regulator, an investigation, a dispute or a legal claim. When information is no longer required, it will be securely deleted, destroyed or de-identified.

7.4 Certain transaction information recorded on a public blockchain, including wallet addresses and transaction hashes, may remain publicly accessible and cannot be altered or deleted by Coin Pro, even if related Personal Information held by Coin Pro is later corrected or deleted.

Security

8.1 Coin Pro applies reasonable technical and organisational measures designed to protect Personal Information against loss, unlawful access, unauthorised disclosure, alteration, damage or destruction.

8.2 These measures may include access controls, authentication, secure storage, encryption where appropriate, system monitoring, confidentiality requirements and security obligations imposed on service providers.

8.3 No method of internet transmission or electronic storage can be guaranteed to be completely secure. You are responsible for protecting your login credentials and notifying Coin Pro promptly of any suspected unauthorised access.

8.4 Where required by POPIA, Coin Pro will notify the Information Regulator and affected persons of a security compromise as soon as reasonably possible.

Your Rights

9.1 Subject to applicable law, you may request confirmation of whether Coin Pro holds Personal Information about you, request access to that information, request the correction of inaccurate or incomplete information, object to certain processing, withdraw consent and request deletion where Coin Pro is no longer legally entitled to retain the information.

9.2 You may lodge a privacy complaint with Coin Pro or the Information Regulator.

9.3 These rights are not absolute. Coin Pro may be required to retain or continue processing information to comply with legal or regulatory obligations, investigate unlawful activity or establish, exercise or defend legal claims.

9.4 Coin Pro may request proof of identity before responding to a request in order to prevent unauthorised access to Personal Information.
